By accessing or using Pediatric Obesity Care Alliance ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Platform.

2. Description of Service

Pediatric Obesity Care Alliance is a referral and matching platform that connects parents and caregivers with licensed healthcare professionals specializing in pediatric weight management and related services.

Important: We are a referral service only. We do not provide medical advice, diagnosis, or treatment. All healthcare services are provided directly by independent healthcare professionals, not by Pediatric Obesity Care Alliance.

3. Eligibility

You must be at least 18 years old to use this Platform. By using the Platform, you represent and warrant that you meet this age requirement.

4. User Responsibilities

4.1 Accurate Information

You agree to provide accurate, current, and complete information when using our services, including when completing the quiz or submitting referral requests.

4.2 Prohibited Uses

You agree not to:

Use the Platform for any unlawful purpose
Submit false, misleading, or fraudulent information
Attempt to gain unauthorized access to the Platform or its systems
Use automated systems to access the Platform without permission
Harass, abuse, or harm other users or healthcare professionals

Pediatric Obesity Care Alliance does not provide medical advice, diagnosis, or treatment.
Our quiz and matching service are not substitutes for professional medical advice.
Always seek the advice of qualified healthcare providers with questions about medical conditions.
Never disregard professional medical advice or delay seeking it because of information on this Platform.
If you think your child may have a medical emergency, call your doctor or 911 immediately.

6. Healthcare Professional Relationships

Healthcare professionals in our network are independent practitioners. Pediatric Obesity Care Alliance does not employ these professionals, control their medical judgments, or supervise their care. Any professional relationship or care provided is directly between you and the healthcare professional.

7. No Guarantee of Results

While we carefully vet professionals in our network, we do not guarantee specific health outcomes, successful matches, or that you will achieve particular results from working with a matched professional.

8. Fees and Payment

Use of our Platform for families (taking the quiz and receiving a match) is free. Any fees for professional healthcare services are separate and will be discussed directly between you and the healthcare professional.

9. Privacy

Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

10. Intellectual Property

All content, features, and functionality of the Platform, including but not limited to text, graphics, logos, and software, are the exclusive property of Pediatric Obesity Care Alliance and are protected by copyright, trademark, and other intellectual property laws.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, PEDIATRIC OBESITY CARE ALLIANCE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability for any claims arising from your use of the Platform shall not exceed $100 USD.

12. Indemnification

You agree to indemnify, defend, and hold harmless Pediatric Obesity Care Alliance and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising from your use of the Platform or violation of these Terms.

13. Termination

We reserve the right to suspend or terminate your access to the Platform at any time, with or without notice, for any reason, including violation of these Terms.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes by posting the updated Terms on this page and updating the "Last Updated" date. Continued use of the Platform after changes constitutes acceptance of the new Terms.

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
